1. Who we are

Sibona is operated by GOLDMIND AI CONSULTING - FZCO, a company registered in the United Arab Emirates under registration number Licence No. 67869 (Dubai Integrated Economic Zones Authority), with its registered address at IFZA Business Park, DDP, Premises No 67869-001, Dubai Silicon Oasis, Dubai (“we”, “us”). These terms are an agreement between you and that company.

These terms, together with our privacy notice, the health-data consent and the refunds and cancellations page, govern your use of the website and the service. By using the service you agree to them. If you do not agree, please do not use it.

2. What Sibona is, and what it is not

Sibona is a wellbeing service: a private space in which you can write about what is going on in your life and receive a written reply generated by an artificial-intelligence language model.

It is not a medical service. It cannot advise you about your health, it does not assess, manage or resolve any health condition, and it is not a substitute for care from a qualified health professional. Nothing it says should be relied on as medical, legal or financial advice.

It is not an emergency service. We cannot dispatch help, contact anyone on your behalf, or know where you are. If someone’s life or safety is at risk, use the emergency numbers on our get help now page.

No human is monitoring your conversation as it happens. Automated safety checks run on the service, but nobody is reading along live and able to intervene.

3. Age

The service is for people aged 18 and over. You confirm your age before your first message. If we learn that an account belongs to someone under 18 we will close it and delete the data associated with it.

4. Your account

You need an email address to create an account. Keep your sign-in details to yourself; you are responsible for what happens on your account. Tell us at once if you think someone else has access to it. You may close your account at any time from the account page, which deletes your conversations as described in the privacy notice.

5. How you may use the service

Use it for yourself, lawfully, and in a way that does not harm other people. You may not:

  • use it to plan or carry out anything unlawful, or to harm or threaten anyone;
  • attempt to extract the underlying prompts or models, scrape the service, or resell access;
  • upload anyone else’s personal information without a lawful reason;
  • submit content that is unlawful, or that you have no right to share;
  • overload, probe or interfere with the service or the systems it runs on.

Automated safety checks may interrupt a conversation and show you emergency numbers. We may suspend or close an account that breaks these rules, and we will tell you why unless the law prevents us.

6. Free answers and subscriptions

Every visitor gets 5 free answers before signing in, and 5 more when they create an account (10 in total). After that, continued use requires a subscription. Current prices are shown on the pricing page in South African rand and include any applicable taxes.

  • Auto-renewal. A monthly subscription renews every month and a yearly subscription renews every year, automatically, until you cancel. Each renewal is charged to the payment method on file.
  • Fair use. A subscription covers up to 600 answers per calendar month. We will warn you inside the chat before you reach that limit. Sustained use far beyond it, or use that suggests automation, may be limited.
  • Payment processing. Card payments are processed by Stripe. We do not receive or store your card number.
  • Price changes. We will give you at least 30 days’ notice by email before a price change affects a renewal, and you may cancel before it takes effect.

7. Cooling-off, cancellation and refunds

You may cancel your subscription at any time from the account page or by emailing us. Cancellation stops the next payment; you keep access until the end of the period you have already paid for. We do not pro-rate a period that has already started, except where the law requires it.

Under section 44 of the South African Electronic Communications and Transactions Act 25 of 2002 you may cancel an electronic transaction within 7 days, without reason and without penalty, and receive a refund of what you paid.

8. AI-generated answers

Answers are generated by a language model. They can be wrong, incomplete or unsuitable for your situation, and two similar questions can produce different answers. You are responsible for what you decide to do. Check anything important with a qualified person.

You keep whatever rights you have in what you write. You give us permission to process it to run the service — to generate your replies, run safety checks and keep your history — as described in the privacy notice. We do not use your conversations to train our own models, and our contracts with model providers do not permit them to train on your content.

9. Privacy

How we handle personal information, including the special personal information you may share about your health or state of mind, is set out in the privacy notice and the separate health-data consent.

10. Availability and changes

We aim to keep the service available at all times, but we do not guarantee it. Maintenance, failures at our providers or events outside our control may interrupt it. We may add, change or remove features. If we discontinue the service altogether, we will give you reasonable notice and a refund of any period you have paid for but cannot use.

11. Liability

To the fullest extent the law allows, our total liability to you for any claim connected with the service is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence, or for fraud.

12. Governing law and disputes

These terms are governed by the laws of the Republic of South Africa, and disputes are subject to the the courts of the Republic of South Africa courts. Nothing in this clause removes a right you have as a consumer under South African law, including your right to complain to the National Consumer Commission or to the Information Regulator.

13. Changes to these terms

We may update these terms. If a change materially affects you, we will tell you by email or in the app at least 14 days before it takes effect, and using the service after that date means you accept the new version. Earlier versions are available on request.
